FORS. https://doi.org/10.48573/403k-ap60 The data user undertakes to: 1. use the above-mentioned reference data set and the associated data documentation (hereinafter: "data") exclusively for scientific research and for the project described in this agreement and in the research outline. The research outline must have been submitted by the data user to the project management prior to receipt of the data and approved by the project management; 2. obtain prior written consent from the project management (see Team z-proso [1]) for uses of the data that go beyond scientific research (e.g., academic teaching, commercial purposes); 3. use the data in compliance with Swiss federal law and the applicable data protection provisions (Federal Act on Data Protection [2]; Cantonal Act on Information and Data Protection [3]); 4. not attempt to attribute the data to individuals and ensure that any communication of results prevents identification of individual cases (e.g., persons, households, institutions, etc.); 5. respect the confidentiality of personal data and not disclose any information that could compromise this confidentiality, keeping secret any information that is not public or generally accessible; 6. use the data to the best of their knowledge, carefully observe the provided data documentation, and respect the rules of good scientific practice; 7. cite the used data and documents according to scientific standards (using the above citation); 8. submit manuscripts of scientific publications that are substantially based on the research data obtained under this contract to the project management (see Team z-proso [1]) for review at least 30 days before the initial submission. The project management may claim co-authorship if justified; 9. indicate the relevant funding institutions and research credit numbers in any publications substantially based on the research data obtained under this agreement. The relevant information can be found in the "zproso_FundingAcknowledgement" documentation; 10. inform FORS and the project management about all publications and student theses (Master's/Doctoral Thesis) based on the research data received under these Terms of Use, including the relevant bibliographic information/links (DOI) within 90 days of the first publication; 11. make the data and instruments available only to the persons listed in the research outline ("co-users") and not pass them on to third parties, either in original or edited form, without prior written consent from the project management. Any changes to the co-users must be communicated to the project management before the data is released; 12. securely store the data and data documentation to prevent access by third parties, taking necessary measures to avoid unauthorized access or data loss. In the event of data loss, data carrier loss, or possible unauthorized access, the project management must be informed immediately; 13. ensure that co-users and third parties who may use the data comply with these terms of use; 14. permanently delete the data at the latest after the agreed usage period, including destroying all documents, data sets, backup copies, and related materials, and confirm this to FORS. Any statutory retention obligations or contrary contractual provisions remain reserved; 15. acknowledge that violating their obligations regarding data security and unauthorized access may lead to criminal consequences, including penalties under Art. 320 of the Swiss Criminal Code (official secrecy), § 40 of the Cantonal Act on Information and Data Protection (processing of personal data in breach of contract), as well as any applicable provisions regarding professional secrecy (Art. 321 and 321bis of the Swiss Criminal Code) or manufacturing and business secrecy (Art. 162 of the Swiss Criminal Code); 16. accept that FORS and/or the project management may withdraw the rights of use without notice or compensation and demand the immediate deletion of the data and instruments in the event of a violation of these terms before the end of the agreed period of use; 17. indemnify FORS, the project management, and the members of the partnership SWISSUbase (University of Lausanne, University of Neuchâtel, University of Zurich) against any claims for damages by third parties arising from grossly negligent or intentional breaches of these terms of use and immediately inform FORS and the project management of such claims; 18. accept the choice of law and submit to Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (Vienna Sales Convention, CISG), with the place of jurisdiction being the city of Zurich, Switzerland, for all disputes arising from or in connection with these terms of use.
