FORS. https://doi.org/10.48573/403k-ap60 The data user is obliged to comply with the following conditions: 1. He/she may use the above-mentioned reference dataset and the associated data documentation (hereinafter: "data") exclusively for scientific research and for the project described in this agreement and in the research outline. The data user must submit the research outline to the project management and have it approved before receiving the data; 2. The authorisation of the research project and the provision of the requested data set is at the discretion of the project management. It may reject a request for data use without giving reasons. Authorisation may be refused in particular (a) if the data user is based in a country that does not have an adequate level of data protection (from the point of view of Switzerland or the European Union), (b) if the research institution at which the data user works would not grant a reciprocal right to make data available, (c) if data is to be processed using artificial intelligence (AI) and there could therefore be a risk of conclusions being drawn about data subjects; 3. For any use of the data that goes beyond scientific research (academic teaching, commercial purposes), he/she must obtain prior written consent from the project management (see project overview/authors [1]); 4. He/she may only use the data in compliance with the applicable data protection provisions (in particular the Swiss Federal Act on Data Protection [2]; Cantonal Act on Information and Data Protection of the Canton of Zurich [3]); 5. She/he may not attempt to attribute the data to individuals. He/she may only communicate his/her results in such a way that it is not possible to draw conclusions about individual persons or cases (e.g. persons, households, institutions, etc.); 6. He/she must respect the confidentiality of any personal data and, in particular, not disclose any information that could compromise this confidentiality. He/she must keep strictly confidential any information of which he/she becomes aware and which is neither in the public domain nor generally accessible; 7. He/she must use the data to the best of his/her knowledge and belief, carefully observe the data documentation provided and follow the rules of good scientific practice; 8. He/she must cite the data used in accordance with scientific practice (using the citation mentioned at the beginning); 9. He/she must submit manuscripts of scientific publications that are essentially based on the research data obtained under this contract to the project management (see project overview/authors [1]) for proofreading at least 30 days prior to initial submission. If necessary, the project management may request co-authorship of a publication; 10. In all publications that are substantially based on the research data obtained under this agreement, he/she must indicate the relevant funding institutions and, if applicable, research credit numbers. The relevant information can be found in the "Funding Acknowledgement" documentation; 11. He/she must inform FORS and the project management of all publications and student theses (Master's thesis, doctoral thesis) based on the research data received within the framework of these terms of use, including the relevant bibliographic details/links (Digital Object Identifier (DOI)) within 90 days of the first publication; 12. He/she may only make the data available to the persons listed in the research outline ("co-users") and may not pass it on to third parties in either its original or edited form. Disclosure to third parties is only permitted with the prior written consent of the project management. The project management must be informed of any changes to the co-users before the data is released; 13. He/she must store the data securely by restricting access and take the necessary technical and organisational measures to prevent unauthorised persons from gaining access to the data or data from being lost. In the event of loss of data or data carriers or possible unauthorised access by third parties, the project management must be informed immediately; 14. He/she must impose these terms of use in an appropriate manner on the co-users listed in the research outline and any third parties who are authorised to use the data, and ensure that these persons comply with all the obligations mentioned therein; 15. He/she must permanently delete the data (in particular, destroy all documents, data records, backup copies or other documents) at the latest at the end of the agreed period of use and confirm this to FORS. Any statutory retention obligations or contractual provisions to the contrary remain reserved; 16. He/she acknowledges that the violation of the obligations mentioned in this user agreement may result in criminal or civil sanctions; 17. He/she accepts that FORS and/or the project management may withdraw the rights of use to the data without notice and without compensation and demand the immediate deletion of the data before the end of the agreed period of use if the data user violates these terms of use; 18. He/she undertakes to indemnify FORS, the project management and the members of SWISSUbase (simple partnership of the Universities of Lausanne, Neuchâtel and Zurich) against any claims for damages by third parties arising from the grossly negligent or wilful breach of these Terms of Use and to inform FORS and the project management immediately of any such claims for damages; 19. Swiss law shall apply exclusively. The exclusive place of jurisdiction for any disputes arising in connection with these terms of use is Zurich/Switzerland.
