Distributed by FORS, Lausanne, 2014. www.optimusstudy.org OPTIMUS STUDY RESEARCH DATA - APPLICATION FOR DATA USE Part 1 NOTE: All persons wishing to use the Optimus Study Research Data ("Data") must adhere to the Optimus Study Data Use Policy as outlined in Part 2. Applicants wishing to obtain the data from the FORS database must submit a Data Use Proposal to FORS. Please submit a proposal (on a separate sheet) identifying at a minimum: a. the statement of research purpose, b. research questions and hypotheses that will be addressed with the data requested, c. the analysis plan, d. the project publication plans, and e. the time period of the proposed research This Proposal will be reviewed for its appropriateness, scientific integrity, and feasibility by the data use committee (project manager Optimus Study at the UBS Optimus Foundation and one external expert). The proposal also must be in line with the overall aim of the Optimus Study to contribute to reducing victimization and improve the response to children affected by sexual abuse. Following the approval of the proposal by the data use committee, the Applicant will complete a data use agreement form, whereby the applicant will agree to: a. acknowledge and adhere to the terms of the Optimus Study Data Use Policy, b. not share or give any of the content of the data provided from FORS with third parties, c. use the data provided only for the purposes as outlined in the Data Use Proposal and approved by FORS, and d. give appropriate publication credit to the Optimus Research team on any papers, posters, abstracts or other dissemination of findings resulting from the provided data. Upon satisfactory completion of the prior steps, FORS will provide the data to the applicant. This data will not contain personal identifiers. This data will most typically be provided in electronic format as an SPSS portable file. Researchers will be responsible for translation of this data into formatting for subsequent data analysis. OPTIMUS STUDY RESEARCH DATA USE POLICY Part 2 The Optimus Study is a cross- national initiative on prevalence and annual incidence of child sexual abuse as well as associated consequences, risk and protective factors and service response. The project was initiated by the UBS Optimus Foundation. Its purpose is to contribute to reducing victimization and improve the response to children affected by sexual abuse. Provision of the Optimus Study research data to data recipients will not be considered to grant any proprietary rights over that data to the data recipient. Thus, if another interested party requests data for similar purposes, FORS and/or UBS Optimus Foundation will have the right to provide that data to another researcher. A) Permitted Data Use Data Recipient may use and/or disclose the data for its scientific research activities and secondary analyses i) within the scope as described by data recipient in the "Application for Data Use", ii) according to the Data Use Agreement and iii) according to the following terms and conditions: Thus, in particular, Data Recipient agrees to 1. acknowledge and agree that UBS Optimus Foundation co-owns (together with the universities who collected the data) all legal right, title and other proprietary and intellectual property rights to the data, including the publication rights. 2. not share with or give any of the content of the data provided from FORS to third parties. 3. use or disclose the data only as permitted for the scientific research and secondary analyses in an ethically correct manner and only within the scope of the permitted use and outlined in the "Application for Data Use". The Data must not be used for any other purpose. 4. to give appropriate publication credit to the Optimus Study research team on any publications, abstracts or other dissemination of findings resulting from the provided data. 5. source the data or the respective project results as follows: Optimus Study, initiated and funded by UBS Optimus Foundation – 2009-10 [Dataset]. Distributed by FORS, Lausanne, 2014. www.optimusstudy.org 6. maintain electronic data security, ensure privacy for all the data and use appropriate safeguards to prevent use or disclosure of the data other than permitted. 7. to supply to FORS any copies of publications, papers, and/or presentations based in whole or in part on the data, which will also be forwarded to UBS Optimus Foundation. 8. to update FORS once a year about the ongoing work on the data for the duration of the reuse, including confirmation of the security procedures and storage being used and names of analysts assessing the data. This report will be forwarded to UBS Optimus Foundation. 9. to send a termination report including description of process and outcome of the research (max. 1 page), publications produced by the data and a confirmation of the destruction of the data on all hard drives, CDs and any other storage mediums upon completion of the project or after three years at the latest. This report will be forwarded to UBS Optimus Foundation. B) Term and Termination The right to use the data shall continue for so long as Data Recipient retains and requires the data for the permitted use, but a maximum period of three years only. FORS or UBS Optimus Foundation may terminate this grant in the event of Data Recipient's breach of these terms and conditions and if Data Recipient fails to cure its breach within (30) thirty days. Following completion of the proposed research or at the latest three years after receipt of the data, the data recipient must return data files and/or destroy data files. This will not include files and/or output that is generated in the process of the approved data analysis, which the data recipient may retain for future reference. C) Warranty / Liability The data is provided "as is" and "as available". FORS, UBS Optimus Foundation or the Optimus research team (altogether the "Data Provider") make no representations or warranties of any kind, either express or implied, with respect to the data, including but not limited to warranties of title, non-infringement, merchantability or fitness for a particular purpose. Without limiting the foregoing, the data provider does not warrant the accuracy, timeliness, completeness, reliability or availability of the data. To the fullest extent permitted by law, in no event shall the data provider or any of its directors, employees or agents have any liability whatsoever to any person for any direct or indirect loss, liability, cost, claim, expense or damage of any kind, whether in contract or in tort, including negligence, or otherwise, arising out of or related to the use of all or part of the data. D) Miscellaneous Any violation of this Data Use Policy and/or any terms of the Data Use Agreement by the Data Recipient will be followed by revocation of the permission for the Data Recipient to use the data along with all files and output related to data analysis of the data. FORS and/or UBS Optimus Foundation reserve all rights to alter the terms of the Data Use Policy if deemed necessary. Such alteration of Data Use Policy terms will be provided to researchers through written notification and requiring signing of a revised Data Use Agreement. OPTIMUS STUDY RESEARCH DATA USE AGREEMENT Part 3 This Agreement is made between FORS Swiss Centre of Expertise in the Social Sciences c/o Université Lausanne, 1015 Lausanne, an organization incorporated under the laws of Switzerland ("FORS"), and ___________________ [INSERT name of individual] ("Data Recipient"), Except as otherwise specified herein data recipient agrees to i) make all uses and disclosures of the Data Set necessary to conduct the research as described in the Application for Data Use and ii) to adhere to the Optimus Study Data Use Policy. The Application for Data Use and the Optimus Study Data Use Policy constitute an integral part of this agreement.
